In 1945, Edwin Sutherland asked himself the question, is white collar crime crime? He consequently came to the conclusion that white collar crime should be seen as crime in its ordinary sense despite the fact that it does not fit either traditional or Marxist ideas of crime or criminality. His controversial finding was based on the study of a number of unlawful white collar activities which he believed should have been legally classified as criminal, because they satisfied the two abstract criteria commonly regarded by scholars as necessary in the definition of crime. Firstly, they were activities that in one way or another were legally (in statute or common law) described as socially injurious, and secondly, they were activities for which there existed legal penalties. Consequently, Sutherland argued that unlawful white collar activities should be seen and legally treated as crimes that are distributed along the same criminal continuum as ordinary crimes, with the mala in se at one extreme and the mala prohibita at the other.
